Kwesi is charged with causing damage by fire to his own business premises with intent to defraud his insurers. He claims that he was abroad on holiday when the fire started. Graham, a police officer, who was on duty near the fire heard an unknown woman shout, “Hey, what are you doing with your place burning and you going away from the fire?” as a man resembling Kwesi drove past on a motorcycle. The Prosecution wishes to call Graham to give evidence of this statement in order to show that Kwesi was in the vicinity of his business premises at the time of the fire.
