You are representing a Defendant in the Crown Court. Your client has told you privately that he admits being present at the scene of the crime, a robbery, but he did not carry out the robbery. You conduct your cross-examination of a police witness on that basis, i.e. you do not challenge the evidence that your client was at the scene. When the Defendant comes to give evidence, he denies that he was present at the scene. The judge notices that you did not challenge the police witness on this point and, having sent the jury away, demands that you make it clear to the jury upon their return whether you forgot to challenge that evidence in your cross-examination, or whether your client has changed his story. What should you do in this situation?
